Payments and allocation of the members of the municipal corporation of the City Council of Paterna de Rivera. Term 2015-2019

Once the new City Council was formed the last 13th June of 2015, resulting from the Local Elections is necessary to precede to the establishment on the basis of dedication of the political members of this Corporation.

Considering that according to the article 75 of the law 7/1985 the 2nd April, Regulatory of the Bases of the Local Basis and in the article 13 of the Royal Decree 2568/1986 the 28th November, by which it is approved the Regulation of Organization, Functioning and Legal Basis of the Local Entities (ROF), the members of the Local Corporations have the right to receive payments for the exercise of their positions when they execute it with exclusive or partial dedication, as well as to receive the compensations in the amount and conditions that establishes the Plenary Session of the Corporation in terms of assistance by the effective concurrence to the sessions of the collegiate bodies of which they are part of.

As well, according to the article 23 and the next ones of the cited ROF, the Municipal Political Groups have the right to have a minimal infrastructure of material and personal resources for the exercise of the position, which given the functional possibilities to of this City Council and at the view of the article 73.3 of the Regulatory Law of the Local Basis, it is advised to assign an economic amount per month, which will include a fixed component for all the groups and other variable according to the number of its members, which cannot be destined by the Groups to the payment of remunerations of staff of any kind to the service of the City Council, nor to the goods acquisition that can constitute fixed actives of patrimonial character.

The presented proposal does not exceed the established limits by the Law 27/2013 the 27th December, of rationalization and sustainability of the Local Administration, which added the articles 75 bis and 75 ter of the Law 7/1985 the 2nd April Regulatory of the Bases of the Local Basis.

It is presented to the Plenary of the Corporation the following agreement proposal:

FIRST: Establishing the position on the basis of exclusive dedication described:

     * Delegation of Environment, Festivities and Roads and Works.

     * Delegation of Equality, Social Welfare and Civic Participation.

     * Delegation of Urban Planning and Employment.

Each of the three positions will receive some brute payments of 1.585 Euros at the rate of 14 annual pays.

The receipt of these payments will be incompatible with the exercise of every kind of retributive activities and with that of any other kind of retribution with charge to the budgets of the Public Administrations and entities, organizations and enterprises dependent upon it. In the same way, it will be incompatible with the compensations for the assistance to collegiate bodies of the City Council of Paterna de Rivera.

SECOND: Establishing the basis of partial dedication at the 75% of the working day to the described:

     * Delegation of Promotion, Youth, Health, Consumption and Services.

Receiving the position some brute payments of 1.188 Euros at the rate of 14 annual pays.

The receipt of these payments will carry inherently the exercise of the functions above detailed and a minimum effective presence in the City Council of the 75% of the habitual working day, being it compatible with the exercise of other paid activities in the terms considered in the article 75 of the Law 7/1985 the 2nd April, regulatory of the Basis of the Local Base, in concordance with that ordered by the Law 53/1984 the 26th December, of incompatibility of the staff to the service of the Public Administrations, prior approval by the Plenary, in its case, of the corresponding compatibility.

THIRD: Establishing in favor of the members of the Corporation with no exclusive or partial dedication the following base of compensations:

  1. Due to effective assistance to the Plenary sessions: 80 Euros.
  2. Due to effective assistance to the sessions of the Informative Commissions: 20 Euros.
  3. Due to assistance to the sessions of the Local Government Board: 325 Euros.

FOURTH: Establishing in favor of the different Municipal Political Groups a monthly compensation for expenses in the exercise of their functions the following amounts:

  1. Fixed component: Per each Political Group and month: 250 Euros.
  2. Variable component: Per each town councilor and month: 58 Euros.
